Abstract

Currently, there are some 8.000 prostitutes working in Finland annually, half of them Finns and the majority working part-time. On a daily basis, about a quarter and during the year one third of them work with or under the control of the pander.

Reasons why people end up as prostitutes are various. The field of prostitution is divided ethnically: the Finns offer traditional sex services (incalls/outcalls) and special services, the Thais offer erotic massage and the Russians and Estonians visiting Finland usually offer only traditional sex services.

A part of prostitution is associated with serious social problems, such as crime, poverty, social marginalisation and drug abuse. The situation of the illegal immigrants is especially bad: they cannot enter the official labour market or turn to public services (such as police or health care) even in acute situations.

Besides the international organized criminal procuration, there are other forms of organizations in the field, too. The prostitutes maintain online discussion forums and organize meetings. Informal networks arise around studios, massage parlors and assistance organizations. Sex workers also have national and international unions. Still, the majority of the prostitutes don’t know anyone else working in the business.

Even though prostitution is found in every society, the social, cultural and economic characteristics of each society have an effect on the volume and forms of it. The Finnish prostitution legislation has been greatly revised during the last few years. Thephenomenon of prostitution has reflected the slow rise in income level in Russia and Estonia, the growing income disparities in Finland, the Estonian EU membership and the discussion about prostitution in the Finnish media.

The most significant changes that have taken place in the field of prostitution in Finland during the last few years have been the decrease in temporary prostitution by the Russians and Estonians, the Estonian prostitutes becoming independent, and the possibleincrease in the number of Finnish prostitutes. The ”precision prostitution”, where the client invites the seller to his home for a few days to do for example household chores in addition to sex services, has replaced the ”girl buses” from Murmansk.

The beginning of substitution treatment in Finland has cut down the proportion of injecting drug users in prostitution. As the new communication technology is becoming more and more common and changes are being made in legislation, the internet is gradually replacing streets, restaurants and newspapers as a way to find customers.

Sex work is no dream job

A Thai woman who has worked here a year as a masseuse wants to go home

It's around noon and a watering-hole in downtown Helsinki is already doing a roaring trade. A couple of middle-aged men stand outside in the street smoking cigarettes.
A younger man appears, striding around the corner, and he slows his gait as he passes a net-curtained window at street level. On the other side of the window, Thai Massage is on offer. The man does not step inside, however, and nor do many other people in the neighbourhood this week.

The furore set in motion by Helsingin Sanomat's road-test of Thai massage parlours has driven away the customers. "It's really quiet now", says a beautiful Thai woman sitting on a beige sofa in the apartment behind behind the net curtains.
Using veneer partition walls, a couple of small rooms have been created in the neat and tidy ground-floor flat. On the floor are thin mattresses and a row of rolls of thick tissue paper, massage creams, and oils. A heart-shaped lamp is hanging from the wall, and there is a wall-clock. Radio Nova plays softly in the background.

The woman does not wish to give her name. "I have a daughter and a boyfriend", she says by way of explanation for her reticence.
The woman's daughter is studying in Thailand, and will soon graduate with a degree in computer studies. In part, the girl's university education has been financed with money earned by her mother in Europe.
The 43-year-old mother has lived and worked in Finland as a Thai masseuse for just under a year. Before that she spent nine years in Central Europe, working at a service station.
Her marriage to the gas station owner broke down, and the man found a new woman.
"I figured I ought to leave", she says. So she did.

She is slim and delicate and exceptionally beautiful. Her eyes are heavily made up and a cosmetics bag is lying there on the sofa. The woman is wearing a black tricot knitted blouse and brown slacks. Clean-cut, stylish; nothing frilly or fussy. "I usually have a lot of customers", she says quietly.

The work of a Thai masseuse in Europe is not, however, by any means a dream job for a Thai woman.
"Sex often comes up here. I like the massage work, but sometimes the sex services side of things is rather embarrassing and difficult, as I'm quite shy."
The woman says she often manages to work her way around the requests for sexual favours by telling the customer that she has a Finnish boyfriend. "The Finnish men respect that, and they back off."
She only has good things to say about her clients. The great majority behave politely and pay up without causing any trouble.

The woman is the daughter of a farming family from a small village in Northern Thailand. "It is poor up there. There were seven children in my family."
She left home at 18 to marry a man chosen for her by her father. "The man came from the same village and he had a good profession. He was a teacher."
A year later, her daughter was born. The marriage came to an end after another year. "Did I love him? Well, maybe a bit, yes."
The woman then moved to Europe because her company in Thailand failed and went bankrupt. "We made components for elevators, but business did not go well. A friend of mine from the same village was living in Europe, and she arranged to get me married off here. I figured that I would have a better life in Europe."

But it was not to be. And after ten years in Europe, she intends to return to Thailand. "I'll set up a massage business back there. It's different in Thailand - proper massage."
Her relationship with a Finnish man is also problematic.
"My boyfriend is a young man, and he can have a much better woman than me", she says in a whisper.
Her eyes fill with tears. She gestures towards the massage room and its red light on the wall.
"I'm a bad lady."

The Red Exodus
A study on sex work in Finland

Summary

In this study I examine reasons for selling sex as experienced by sex
workers. Forced prostitution is rare in Finland as a result of free
education, low unemployment and social security benefits that guarantee a
minimum standard of living for everyone. I’m interested in why a person in
Finland decides to sell sex and thus expose himself/herself to the risks of
violence and marginalization involved, when there are other options
available.

The study is based on three years of ethnographic field research in the
world of the Finnish sex business. My main material consists of the messages
on the sex workers’ closed internet discussion channel (11,000 posts from
2003 to 2006) and interviews with 25 sex workers (20 women, two men and
three transgender). All my interviewees are prostitutes, but I call them sex
workers, since the term is often used to emphasize the agency of workers.

Prostitution is a highly marginalized, stigmatized and invisible phenomenon
in Finland. Street soliciting is illegal, foreigners are not allowed to work
at all and even offering sex services in private spaces is strictly
regulated. Still, the position of sex workers is relatively good. Most of
prostitutes work as independent call girls and stay in business for fewer
than five years. As the new communication technologies are becoming more and
more common, the internet is gradually replacing streets, restaurants and
newspapers as a way of finding customers.

For these sex workers, selling sex is an alternative to low-paid and highly
controlled jobs in the service sector. They choose sex work because it
offers them more autonomy in their work but also because it gives them more
free time: one half-an-hour meeting with a customer per day guarantees
higher standard of living than full time service jobs available for them.

Even if the sex work research has concentrated on talking about work, it
should also be noted that some prostitutes sell sex because of their sexual
orientation and interests. It is possible to find many examples of how the
experience of control has emancipated sex workers towards more independent
sexuality. Sometimes sex work in itself can be pleasurable, but even if we
remember that perhaps the most common rating for clients or acts would be
‘indifferent’, there are no clear-cut distinctions between private and
commercial sex in relation to prostitutes’ sexual pleasure.

The study shows that it is hard to make any universal statements about sex
workers’ experience. In the life of an individual prostitute, depending on
different times and contexts, sex work can be either a supporting or a
destructive factor. Instead of arguing that commercial sex is inherently an
abusive practice, we should consider under what kinds of conditions the sex
work takes place.

Finally some comments of mine

The Red Exodus of Anna Kontula is the first contemporary proper research on
sex workers in Finland.

This study tells about things that I already "knew", for example: Finnish
sex workers are mainly doing rather well, there are no big problems with
violence or police. But before this book I could not be quite sure if I
really KNEW these things or just thought I knew.

There are also lot of things that have not been discussed so much, for
example: some of us enjoy our work - not just as work but also as sex. Or:
managing the client situations and being whore can be viewed from different
points of views: labor, intimacy, identity, ethics.

Since I have been in business for over 12 years, nearly all of the things
were somehow familiar. However I enjoyed reading Anna's research very much.
It gave some refreshing points of view. And what is really important for us:
now there is research based knowledge on Finnish sex workers. Now I do not
have to say: " I think that..." Now I can say: "According to Dr Anna
Kontula's research..."

This is exciting and important study. I hope that it will be published in
English too. Anna told that there has been a publisher from Germany
contacting her. But I do not know if it is going to lead to something. If
you know publishers who could translate and publish Anna's book in English,
please tell them about Anna's book and/or contact Anna. Her e-mail is

Finnland

Die Regierung Finnlands plante für 2006 ursprünglich ein Totalverbot der Prostitution mit Strafbarkeit der Freier nach schwedischem Vorbild. Da hierfür keine Mehrheit im Parlament in Sicht war, wurde am 21. Juni 2006 ein modifiziertes Gesetz erlassen. Demnach machen sich Freier lediglich strafbar, wenn sie Dienste von Prostituierten in Anspruch nehmen, die einen Zuhälter haben oder die Opfer von Menschenhandel sind. Der Strafrahmen für Freier liegt in diesem Fall bei Freiheitsstrafe bis zu sechs Monaten oder Geldstrafe. Verboten ist bereits seit längerem öffentliche Werbung für Prostitution und Kontaktanbahnung auf öffentlichen Straßen und Plätzen sowie in Gaststätten.

Leena Lehtolainen: Wer sich nicht fügen will

Maria Kallio leitet das Gewaltdezernat der zweitgrößten finnischen Stadt Espoo. In ihrem neuen Fall ermittelt sie im Mord an der bekannten Edel-Prostituierten Lulu, die kurz vor einer Fernsehdiskussion vergiftet in ihrer Umkleidekabine aufgefunden wird. Die Ermittlungen gehen in alle Richtungen, denn Lulu setzte sich stark für die Legalisierung der Prostitution in Finnland ein und kämpfte gegen den Frauenhandel aus den ehemaligen Ostblock-Staaten. Damit eckte sie an – in Politik und Verwaltung ebenso wie bei der russischen Zuhälter-Mafia.

Noch bevor etwas Licht ins Dunkel dieses Falles dringen kann, wird im Espooer Krankenhaus eine brutal zugerichtete, junge Frau ins Krankenhaus eingeliefert. Als Maria Kallio herausbekommt, dass sie aus der Ukraine stammt und als Prostituierte arbeitet, flüchtet sie. Bei ihren Ermittlungen gerät Kallio immer tiefer in eine Verstrickung aus Politik und Rotlichtmilieu, bis sie selbst in höchste Gefahr gerät.

In jedem ihrer Krimis geht es Leena Lehtolainen nicht nur um die Aufklärung eines spektakulären Falles, sondern auch um ein gesellschaftlich brisantes Thema. Im aktuellen Buch sind es Menschenhandel und die in Finnland völlig verbotene, aber dennoch vorhandene Prostitution. Insbesondere die Zwangsprostitution illegal eingeschleuster junger Frauen aus den ehemaligen Ostblockländern wie Russland und Estland beschäftigt sie. Lehtolainen veranschaulicht nicht nur die Brutalität des Zuhälter-Milieus, sondern sie hinterfragt auch die harte finnische Politik gegenüber den betroffenen Frauen.
Dabei vergisst sie aber nicht, das Privatleben ihrer Heldin Maria Kallio gebührend in Scene zu setzen – die alltäglichen Freuden und Sorgen mit Mann und Kindern ebenso, wie der Stress im Kriminalisten-Beruf.

Die finnische Justizministerin Anna-Maja Henriksson will den Erwerb sexueller Dienstleistungen unter Strafe stellen. Mit der Arbeit an einer entsprechenden Gesetzesreform könne nach der Sommerpause begonnen werden, sagte sie der Tageszeitung „Helsingin Sanomat“. Derzeit ist „Sexkauf“ nur verboten, wenn es sich bei den Prostituierten um Opfer von Zuhälterei und Menschenhandel oder Minderjährige handelt.

Nach Meinung der Justizministerin wird Menschenhandel durch das bestehende Gesetz nicht vorgebeugt. Es sei in der Praxis sehr schwierig, Freiern nachzuweisen, sie hätten gewusst, dass die Prostituierten Opfer von Menschenhandel gewesen seien, sagte Henriksson der Zeitung. Erst im Juni hatte das Oberste Gericht einen Mann mangels Beweisen von der Anklage des „Sexkaufs“ freigesprochen.

„Finnland ist ein Land geworden, in dem sich Menschenhandel lohnt. Prostitution und Menschenhandel gehen Hand in Hand, auch wenn Prostitution nicht immer mit Menschenhandel verknüpft ist“, sagte die Ministerin. Im Herbst will sie auf einem Seminar mit Vertretern der Polizei, der Justiz und von Verbänden über eine eventuelle Gesetzesänderung beraten.

Die Aufgabe des Prostitutionsgesetzes ist nicht das Verhindern und Vorbeugen von Menschenhandel, sondern die Regelung der Rechte und Pflichten von Sexdienstleisterinnen.

Es sollte lieber darüber nachgedacht werden eine vernünftige Europa Politik zu machen, und zu versuchen, die Verhältnisse in den Herkunftsländern der Armutsmigranten positiv zu verändern, damit die Menschen dort Zukunftsperspektiven haben, und nicht gezwungen sind, ohne Bildung/Ausbildung, ohne Sprachkenntnisse, und ohne zu wissen, auf was sie sich einlassen, ins Ausland zu gehen.

Hier sind sie leichte "Beute" für Ausbeutung und Menschenhandel, egal in welchem Job sie arbeiten, sofern sie nicht in der Lage sind, sich eigenständig und selbstbestimmt zu organisieren, und eine qualifizierte Arbeit aufzunehmen.

Das gilt für alle Länder, in die Armutsmigranten gehen mit dem legitimen Ziel ihr Leben zu verbessern

Statistics show that 2006-13, a total of 379 cases of ‘abuse of a victim of prostitution’ were reported to the police. (47 Fälle pro Jahr)
Charges were brought against 49 persons and tried. (6 Verurteilungen pro Jahr)
The district courts have sentenced 42 persons for ‘abuse of a victim of prostitution’ or an attempt thereof. (5 Verurteilungen pro Jahr)
The default fine has been established at 20 day fines.

Fines for purchasing and selling sex, pursuant to the Public Order Act, were imposed in 106 cases 2003-11. (11 Ordnungsstrafen pro Jahr)
Most of these fines were imposed on the sellers. (meist gegen Sexworker)
