San Francisco will shortly vote on a kind of de facto legalization of prostitution within city limits. While the state of California prohibits prostitution, the referendum would prevent city police or prosecutors from spending any money on enforcement of those laws. Even the often-outrageous mayor, Gavin Newsom, thinks this is a bad idea:

The measure, which qualified Friday, would bar authorities from spending money to investigate or prosecute prostitutes for engaging in prostitution.


This is the second time the measure has attempted to get on the ballot. The Erotic Service Providers Union — yes, prostitutes have a union in San Francisco — tried to get enough signatures in 2006 but fell short. They managed to convince enough people to sign it this time, and one wonders if they had to put a new meaning on “by hook or by crook” to do it.

Newsom objects to the measure as an impediment to investigating sex-trafficking crimes. It also might present a major challenge to state sovereignty. If California cities do not have to enforce state laws, then the entire notion of the sovereign state collapses. The California legislature might have to change jurisdictional laws to impose a state police force on San Francisco.

All prurient curiosity aside, this vote could present an interesting political challenge for Californians. If the state lets this stand, where does its sovereignty end, or even begin?

Prostitution measure makes in onto S.F. ballot

A measure that would make it more difficult to investigate and punish prostitution crimes in San Francisco qualified for the November ballot on Friday, opening another passage in the city's long fight over decriminalizing the sex-trade industry.

Proponents of the measure were able to collect more than 12,000 signatures, including those from three members of the Board of Supervisors, to put it on the ballot, according to the Erotic Service Providers Union, the labor group backing the measure. The same group was unsuccessful in putting a similar measure on the ballot in 2006.

The measure would end San Francisco's First Offender Prostitution Program for men who have been arrested for soliciting a prostitute. Men who go to "john school," which was created in 1996, pay $1,000 and attend a class on prostitution in exchange for the district attorney's office dropping the misdemeanor charge against them.

Mayor Gavin Newsom this week said the measure would severely hamper the city's ability to investigate and prosecute sex-trafficking cases. According to the measure's wording, it would prohibit the city from spending money on sex-traffic investigations that involve racial profiling.

"It would make it very challenging to investigate and prosecute human trafficking," agreed San Francisco District Attorney Kamala Harris. "We need to use police resources to investigate where there is a suspicion that women and children, in particular immigrants, are being exploited.

"This measure is nothing more than a welcome mat for prostitutes and pimps to come and hang out in San Francisco," she said.

The main goal of decriminalization, proponents say, is the safety of prostitutes.

"Workers would like it if crimes like rape, robbery theft and coercion were vigorously investigated and prosecuted," Maxine Doogan, a founder of the Erotic Service Providers Union, wrote in an e-mail. "We want the right to make reports of crimes against us without being retaliated against by the Police Department."

The measure is hardly the first attempt to decriminalize prostitution in San Francisco. Terence Hallinan frequently supported decriminalization efforts during his tenure as district attorney and on the Board of Supervisors.

In April this year, Supervisor Jake McGoldrick, long in favor of decriminalization, requested an audit of the first offender program, questioning whether the program was worth supporting. A report by the U.S. Department of Justice this year found that men who participated in the program were 30 percent less likely to be rearrested for soliciting a prostitute than men who did not attend the class.

The program was born from San Francisco's Task Force on Prostitution, which was created in 1994 by the Board of Supervisors to consider revisions to prostitution laws and how the city enforces them. In 1996, the task force recommended that the city stop prosecuting prostitution crimes and instead focus on social services related to the sex trade.

SAN FRANCISCO (KCBS) -- Supporters of Proposition K, a measure to decriminalize prostitution in San Francisco, have failed to keep their opponents' arguments out of the voter pamphlet.

A superior court ruling says the No on K campaign can argue that adopting the measure would prohibit police from arresting prostitutes, as well as their pimps and their johns, said Jim Sutton, an attorney for No on K.

Sullivan says his side can also argue that women who are forced into the sex trade would have no legal protections.

Today the opponents of Proposition K conceded that several of their
key arguments are opinions and not verifiable facts. Proponents of
the Prop K filed a complaint charging that the paid
ballot arguments opposing prop K contained numerous "false and
misleading" statements. However, Judge Mahoney agreed with the
opposition that paid ballot arguments don't have to be substantiated
in fact
. As per the disclaimer at the bottom of the voter information
guide, paid ballot arguments are opinion and nothing printed in the
voter guide is verified by any agency.

"The opponents of Proposition K have based their campaign on deceptive
scare tactics alleging that investigations and prosecution of human
trafficking would be negatively affected by Proposition K's passage.
Nothing could be further from the truth and we ask the opponents of
Proposition K to stop this deplorable acts." said Yes On Proposition K
spokesperson Maxine Doogan.

"These kinds of scare tactics are similar to one's used by anti-gay
rights crusader Anita Bryant in the 1970's to oppose the
decriminalization of sodomy laws which were used to oppress
homosexuals', said Attorney and civil rights activists Phil Horne.

"Proposition K will improve worker and public safety by
decriminalizing sex-for-hire work, this Proposition is fundamentally
about extending basic human rights to all members of society
regardless of their occupational status.
It in no way prevents the
enforcement of laws against human trafficking, in fact Prop K says the
opposite. This ruling should serve as a warning to the voters of San
Francisco of the dishonest practices of the No on K campaign." added

Ballot measure to decriminalize prostitution divides liberal San Francisco

Sex workers, the county Democratic committee and a health official support Proposition K as a boon to prostitutes' and the public's safety. The mayor, the D.A. and the business community oppose it.

SAN FRANCISCO -- At age 22, Patricia West already has her small-business model fully launched. She's done her market research, knows how to advertise online and has a competitive rate structure.

There's just one problem: She works in the world's oldest profession, which is illegal.

In industry parlance, West is an in-call sex worker. Clients meet her in safe locations. Though this helps her avoid the violence and arrests that routinely come with working the streets, she's always on guard for police stings on the Internet.

West wants that to change. She believes all sex workers, including exotic dancers and porn stars, should be able to ply their trade free of the discrimination that comes with a criminal record.

She's one of a number of sex workers waging a campaign to decriminalize prostitution here. They're supporting Proposition K, which would shift the city's focus from prosecuting prostitution to pursuing those who prey on sex workers and increasing public health outreach. The goal, West says, is to reduce violence against women and improve the health of sex workers and their clients.

"It's a morally based, antiquated law," she said. "Decriminalize prostitution and you bring it out of the underground and off the black market. That way you can start organizing, clean up the dangerous elements. Sex workers want safe streets like everyone else."

The battle over Proposition K is causing political rifts in this free-thinking city, which for years has wrestled with ways to effectively regulate its vibrant sex industry.

The measure is opposed by Mayor Gavin Newsom, Dist. Atty. Kamala Harris and much of the business community, who say it will attract unwanted criminal elements to the city and hamper efforts to fight human trafficking.

But it also has powerful backers. Placed on the Nov. 4 ballot after receiving 12,000 petition signatures, Proposition K was recently endorsed by the Democratic County Central Committee. The measure is also supported by Jeffrey Klausner, director of STD control and prevention for the city's health department.

"When a female sex worker talks to her doctor, she's often not forthcoming about her occupation for fear of arrest," he said. "Doctors can't give adequate care without knowing a patient's occupational risks."

Klausner said he hasn't discussed his support for Proposition K with his bosses at the health department and acknowledges there may be a political price for his activism. "But sometimes you just have to do the right thing," he said.

The prostitution issue makes for uncomfortable politics. At least three supervisors voted to endorse the measure in the Central Committee tally, including Supervisor Jake McGoldrick. But asked about his support this week, his office declined to comment.

Former supervisor and Central Committee member Leslie Katz, an attorney, said she also voted to endorse the measure.

"I walked into the meeting planning to vote no, but there was compelling testimony about STD statistics. A lot of people are engaged in prostitution without practicing safe sex," she said. "But listen, this measure isn't perfect. I'm still conflicted."

Proposition K would ban San Francisco police from using any public resources to investigate or prosecute sex workers on prostitution charges. Critics say the law would attract pimps, human smugglers and others who profit from the sex trade.

"Prostitution is not a victimless crime," said Harris, the district attorney. "It's a crime that victimizes neighborhoods and plagues communities and compromises the quality of life of the people who live in those neighborhoods. This measure would prohibit us from putting public resources into helping those residents. And that's not acceptable in this community."

Proposition K isn't the first attempt to decriminalize prostitution in the Bay Area. A similar effort by San Francisco sex workers two years ago failed to get enough signatures to be placed on the ballot. In 2004, Berkeley residents voted down a similar measure.

Terence Hallinan, San Francisco's district attorney from 1995 to 2003, has long supported decriminalizing prostitution. He thinks Proposition K is a step in the right direction.

"I support the concept that prostitution is something that should be legalized but controlled. But how far citizens can go in telling police how they can spend their money is legally at issue," Hallinan said.

If Proposition K were to pass, San Francisco would join 11 Nevada counties and the state of Rhode Island, which take a more liberal stance toward prostitution.

Hallinan calls that progress.

"What it says is that San Francisco is strong on personal liberties; it's not a kooky city at all," said Hallinan, who after leaving public office has represented Mitchell Brothers, which owns sex clubs and theaters here. "People here are willing to say they need a change. They take positions that may seem a little out there, but in the end so often have turned out to be right."

The city's Erotic Service Provider's Union, which spearheaded the initiative, argues that in countries such as the Netherlands, New Zealand and Thailand, where payment for sex is allowed, sex workers are more likely to use condoms and have lower rates of sexually transmitted infections.

But in San Francisco, prophylactics are often seized, backers of the measure say. "Condoms are used by police and prosecutors as evidence of illegal activity, so sex workers are less likely to carry or use them," Klausner said.

Critics say that argument is simply false.

"Condoms are evidence that prostitution is going on, but it's not evidence against the sex worker themselves but the location of where the crime is committed," said Tim Hettrich, who retired this year as a captain in the Police Department's vice and narcotics unit. "There's no law against carrying a condom, or we'd be arresting 16-year-old boys."

Proposition K would force police to target people who prey physically on prostitutes -- including thieves and johns.

Hettrich, the retired policeman, said those risks are overstated.

"Obviously, these people are victimized," he said. "Customers say, 'I'm not going to pay this prostitute, I'm going to smack her.' But I don't think the magnitude of that violence is that high. And this new law would not stop the brothel owners and pimps from getting violent, it would help them. It'll make it harder for police to zero in on their work."

No proposal along the lines of Proposition K is on the horizon for Los Angeles.

"I think L.A. is many years behind San Francisco in terms of sexual politics, sexual rights," said Mariko Passion, founder of the Sex Workers Outreach Project Los Angeles. "To have an opinion about what sex worker rights really mean, the awareness is not there at all."

Patricia West says she moved to San Francisco from Texas last year because of the Bay Area's reputation for activism. If sex workers are going to earn equal rights through the polls, she thinks this city is where it's going to happen.

"This work has afforded me so much -- a six-figure income and the ability to travel the world," she said. "This is my profession. And I'll keep doing it, as long as I'm comfortable, happy and safe."

Having worked for more than 20 years in the field of anti-trafficking, I would like to share with you my analysis of the Initiative Measure Entitled "Enforcement of Laws Related to Prostitution and Sex Workers."

The proposition would require the Police Department to rigorously enforce existing laws against coercion, extortion, rape and other violent crimes, regardless of the victim's status as sex worker; to not use public resources for the investigation and prosecution of sex workers for prostitution related offences, nor for racial profiling as a means of targeting alleged trafficking victims and to decriminalise prostitution.

According to my opinion, the proposition would substantially contribute to the effective combat of trafficking in persons and to a better protection of sex workers against violence and abuse for a number of reasons.

In the first place, a persistent problem in combating trafficking is the lack of willingness of victims to report the crime. One of the reasons is the fear to be prosecuted themselves for prostitution. The criminalisation and prosecution of prostitutes feeds into this fear, and in doing so benefits the traffickers while deterring the victims to report the crime. In fact, one should be aware that any measure that further stigmatises and marginalises prostitutes adds to their vulnerability to trafficking and other forms of violence and abuse.

Secondly, because of their status of prostitutes most victims of trafficking do not trust the police and have no confidence that their complaint will be taken seriously and their violators will be prosecuted, no matter if they were coerced into prostitution or knew on forehand they would work as prostitutes. To my experience people can enter prostitution for very different reasons, varying from their own decision to being forced by others. In all cases, no matter how they entered prostitution, they should be entitled to protection against violence and abuse. However, even when one assumes that women cannot choose to engage in sex work and, consequently, that all prostitutes are victims, it makes no sense to prosecute the very victims. Rather it would make sense to redirect funds to instead prosecute trafficking and other crimes against sex workers. This would help to increase the confidence of victims in the police and encourage them to denounce their traffickers.

Thirdly, research shows that victims of trafficking come from all parts of the world, including the country itself. Racial profiling will therefore not add to the effective prevention or prosecution of trafficking. On the contrary, it might divert attention from certain groups of trafficking victims who do not fit the presumptions underlying the concept of racial profiling.

Fourthly, decriminalising prostitution creates the conditions for regulating the industry and the application of health and safety standards. It opens the way to use a whole new array of instruments to suppress trafficking and prevent child prostitution other than the criminal law, which - though necessary - has proven to have only very limited preventive effect.

You probably heard that Prop K didn't win, but we are very proud that
89,833 people (counted so far) voted for us and we secured over 42%
of the votes.

The tally as of Wednesday morning, Nov 5, is:

Yes 89,833 42.44 %
No 121,815 57.56 %


In a crucial way we are winning, because we clearly demonstrate that
sex workers are part of the political process. In 2004 Measure Q in
Berkeley secured 36% of the vote, so as you see we are ascending! It
is clear that in the long run sex workers rights and participation
will be central to prostitution law reform. Decriminalization is
happening!

Thank you to all our donors and supporters. This meant so much to
all of us! You kept our spirits us and allowed us to mount this
campaign!

There was an amazing response from sex workers and sex worker groups
and allies (such as the Woodhull Freedom Foundation) around the
country, contributing, emailing, fundraising phone calls, and rooting
for us! We had wonderful volunteers from all quarters, and we made
many new friends who will be supporting us in the long run.

Our Board of Supervisors went in a liberal direction so that portends
good support for new plans. What next?! Of course SWOP is
organizing a National March for Sex Worker Rights for December 17th,

On 4 November, the US goes to the polls. As we hope for Barrack Obama to win, another historic vote is taking place. The people of San Francisco will be voting on Proposition K to decriminalise sex work and prioritise sex workers’ safety and rights.



Prop K was put on the ballot by sex workers and supporters who collected the necessary 12,000 signatures. We have been working closely with our sister organisation in San Francisco, the US PROStitutes Collective (US PROS), which is part of the Yes on Prop K Coalition. Led by sex workers, the Coalition includes people from all walks of life: mothers and grandmothers, students, doctors, nurses, lawyers, women and community organisations, church people, gay-bi-trans activists… All have been working flat out to get a YES vote. Prop K has received widespread support, including from SF Democratic Party and the Green Party. It has become a national and international news story.



Opposition to decriminalisation is being spearheaded by the prosecuting authorities, property developers and those who benefit from the criminalisation of sex workers such as government funded “rehabilitation” projects. Like here, feminists engaged in a moralistic crusade against prostitution have been vocal, claiming that Prop K will prevent traffickers being caught.



Yet Prop K calls for the vigorous prosecution of rape and any form of violence and coercion, and that includes traffickers. But immigrant sex workers would no longer be targeted for raids and deportation. Those who have the least – often women of colour – and have been most severely affected by criminalisation, would be the first to benefit from Prop K.



In the UK we face government proposals to further criminalise sex workers and clients. This would push prostitution further underground and make women more vulnerable to violence.



Many people all over the world are hoping that the presidential election will mark the beginning of a transformation away from the politics of war, greed and repression. Sex workers in SF are also hoping that Prop K will change the course of law enforcement and end their victimisation.



A victory in San Francisco would follow New Zealand’s successful five-year-old decriminalisation. It would set an important precedent in the US and far beyond for greater protection, well-being and safety for prostitute women and all sex workers.

Rally and mock funeral this week to support Saint James Infirmary‏



Hello Wonderful Fans of the Infirmary-


Many of you may have heard that there is a move to cut over $26
million in health care cuts (DPH) and St. James Infirmary money is
part of the package.

Programs all over the City are getting hashed and slashed. Meanwhile,
the police are still spending $11 million to arrest us and Mayor Gavin
Newsome spends $10 million on his PR campaign to look good doing it!

This is you opportunity to speak out! I am asking all community
members and fans of health care over PR/Police campaigns to tell our
supervisors and our mayor what you prioritize.

Tomorrow is a huge mock funeral and Friday people will speak out to
the supervisors who will be voting on a negative supplemental to stop
the DPH cuts. See below for details:

"We just found out from the Supervisor that there will be a special
hearing on the Negative Supplemental THIS FRIDAY! There is NO MEETING
ON MONDAY:

Friday, December 12 at 11 AM at City Hall, room 250
Gov't Audit and Oversight Committee

It will be introduced on Tuesday, Dec. 16 at 9 AM to the Full Board,
which we should make a presence at but public comment is on Friday."

MOCK FUNERAL:
"Please attend a 12:30 pm rally and march at Civic Center on Thursday
the 11th and let people in our programs know!

The mayor is moving at lightning speed to implement draconian mid-year
budget cuts, asking for over a third of the $75 million budget deficit
to come from the health dept.

Mayor Newsom is trying to balance the budget on the graves of the poor
by compromising the health and well-being of poor and homeless people.
He is attempting to "fast track" his second round of mid-year budget
cuts, while protecting the highest paid positions in city government.

He is doing so without the participation of the legislative branch,
killing off the long-standing tradition of community budget planning
in San Francisco.

Slated for slashing or closure are over $16 million in health dept.
cuts: Caduceus Outreach Services, SRO Collaborative, Mental Health
Treatment, senior programs, Substance Abuse treatment, health
initiatives in poor communities, housing and countless more.

Please join us in holding a mock funeral for these programs that are
being cut. We will hold the service on the lawn across from city
hall, and then have a procession to the mayor's office to deliver a
list of possible alternative cuts that would not jeopardize our
healthcare system and people's lives.
