You can't fight exploitation with prison on the cards

Comrade Paul Levy asked the question, what does the GMB Sex Workers Branch do? (M Star February 25).

He implies that we shouldn't focus our energy against decriminalisation but rather against pimps and trafficking.

So I want to ask him also this question.

How can you fight against this exploitation when each time you attempt to report it you put yourself in the risk of being arrested, fines, prison, your children taken away and being deported?

The GMB Sex Workers Branch has been founded by migrant sex workers and in particular by Ana Lopes, who was our first president.

Our analysis is that to fight against trafficking you need to defend sex workers' right to migrate.

There is no reason to be trapped by a criminal organisation if you can move and work freely like I do as an EU resident.

To fight against pimps - what you call employers or boyfriends for other workers, by the way - you need laws that protect you.

Like in other industries there are laws that workers can use against their employers' abuse or women can use against domestic violence.

But sex workers are excluded from the protection of the law.

Criminalising clients won't provide us protection but on the contrary will attack the only one who currently can still report crimes we suffer without any legal risk.

Through 94 recommendations, the CNCDH asks the government to completely redefine its policy related to not only trafficking and exploitation but also sex work. In particular, the CNCDH follows a human rights perspective by asking for the protection of all, emphasing on an effective protection for foreign victims, and to decriminalize sex work (by decriminalizing "public sollicitation") and deal with the offences committed against sex workers mainly through the general provisions of the law (extorsion, rape, violences, public order, and exploitation as defined by the CNCDH). Not anymore through specific and stigmatizing provisions ("procuring").

It is a first step rather than an achievement. But it is a big step, to read that from an official institution in France."

While many victims of human trafficking for sexual exploitation are assisted within the numerous anti-trafficking programmes developed in countries of destination and origin, an increasingly noted trend has been that many identified victims decline the assistance offered to them. To date, little systematic knowledge has been available on why this is so, and what the consequences are.

This report analyses the issue based on interviews with 39 victims of trafficking and 13 women and transgender persons in street prostitution whose status with respect to trafficking could not be determined, as well as a large number of anti-trafficking actors, in Albania, Moldova and Serbia.


The authors found that victims decline assistance for a large variety of reasons, stemming from their personal circumstances;
- because of the way assistance is organized; and
- due to factors in their social surroundings,
- including negative assistance experiences in the past.
- Many do not accept because they feel it is not a real option, and
- are left to cope on their own with unattended post-trafficking problems.

The insight that victims who decline often have other assistance needs than those catered for within the assistance system today should be incorporated into future assistance planning and design.

Geldern (RP) Die 19-jährige Litauerin Tatjana freute sich auf einen Urlaub in Deutschland. Doch sie tappte in eine Falle. Die junge Frau fiel am Niederrhein brutalen Zuhältern in die Hände.

Die Grünen wollen, dass der Zeugenschutz für Zwangsprostituierte verbessert wird.

Tatjana entkam, als ihre Bewacher betrunken waren. Die Tür des Notausgangs war nicht verriegelt. "Jetzt oder nie", erkannte die 19-Jährige. Am frühen Morgen floh sie zu Fuß aus dem Bordell "La Residence" in Wachtendonk am Niederrhein. Dort war die junge Litauerin von der damaligen Inhaberin zur Prostitution gezwungen worden. Von einer Tankstelle alarmierte sie die Polizei. Das Ende eines Martyriums.

Tatjana war von einer skrupellosen Freundin nach Deutschland gelockt worden. In dem Glauben, sie würden zu einer Urlaubsreise aufbrechen, fuhren die Frauen mit einem Touristenvisum nach Berlin. Dort angekommen, wurden sie von einem Landsmann empfangen, der beide in eine Wohnung brachte. "Mir wurde erklärt, ich hätte Schulden wegen der Kosten für die Reise und das Visum", berichtet Tatjana. "Mir wurde der Pass abgenommen. Da wurde mir klar, dass ich in eine Falle getappt war."

Wie sich später herausstellt, hatte die "Freundin" Tatjana für 100 Euro an einen Zuhälter in Berlin verkauft. Die Litauerin wird in einer Hochhauswohnung festgehalten, wo sie von einem deutschen Ehepaar bewacht wird. Der Mann fährt Tatjana mit dem Auto zu ihren Kunden. Flucht ist unmöglich.

Die Zuhälter setzen Tatjana unter Druck. Sie drohen, ihrer Familie in Litauen etwas anzutun. Und machen ihr Angst vor den deutschen Behörden. Sie würde ins Gefängnis kommen, heißt es. Schließlich sei sie illegal in Deutschland. Das Mädchen ist verzweifelt.

Nach einem Selbstmordversuch scheinen die Zuhälter ein Einsehen zu haben. Tatjana soll ihre Koffer packen, man verspricht ihr, sie würde nach Hause gebracht. Doch die Fahrt endet nicht in Litauen, sondern am Niederrhein. Der Berliner hat das Mädchen für 3000 Euro an die Betreiber des "La Residence" verkauft. "Dort arbeiteten damals viele Mädchen freiwillig", berichtet Tatjana. "Die, die sich in den Ecken herumgedrückt haben, wurden zur Prostitution gezwungen."

Kann auch sein, dass der Fall konstruiert wurde um der Forderung nach Ausweitung des Zeugenschutzprogramms Nachdruck tzu verleihen.

Spielt aber keine Rolle, es gibt leider solche Fälle (laut Polizei gehen 50 % der Betroffenen aus Unkenntnis/Angst nicht zur Polizei).

Dachte immer, Kronzeugenregelung / Zeugenschutzprogramm sei unabhängig davon, ob sie der/die Betroffene legal/illegal ibn Deutschland aufhält?

LOW PAY AND AGAINST UNIONS
The Body Shop pay their store workers low wages at or near the expected minimum wage and well below the official European 'decency threshold' for pay [32]. The company is opposed to trade unions [33], ensuring that they keep labour costs down and that employees are not able to organise to improve their working conditions. None of their workers are unionised [34] so employees are forced to channel their grievances and demands through procedures completely controlled by the company [35]. This isolates workers and denies them collective bargaining power.

EXPLOITING INDIGENOUS PEOPLES
The Body Shop claim to be helping some third world workers and indigenous peoples through so-called 'Trade Not Aid' or 'Community Trade' projects [36]. In fact, these are largely a marketing ploy as less than 1% of sales go to 'Community Trade' producers [37], and it has been shown that some of these products have been sourced from mainstream commercial markets [38]. One such project, which has been the centrepiece of the company's marketing strategy for years, is with the Kayapo Indians in Brazil. The Body Shop have claimed that by harvesting brazil nut oil (used in hair conditioner), the Indians are able to make sustainable use of the forest thereby preventing its destruction by mining and logging companies [39]. But only a small number of the Kayapo are involved, creating resentment and internal divisions within the community [40]. As the Body Shop are the sole buyer of the oil, they can set any price they like [41]. The project does nothing to safeguard the Indians' future interests [42]. Furthermore, the company have used them extensively for PR purposes for which they have not been compensated [43].

<b>Romania is still being pressured to export children.</b>

In 2001 Romania placed a ban on Inter Country adoptions of its children after massive corruption was discovered within these kinds of adoptions. Ever since the ban came into place the Country has been unjustly pressurized by the leading Countries involved in Inter- Country Adoptions. France, Italy, Spain, Israel and the US and UK have all lobbied to get this ban lifted. The politicians in these Countries involved have interests in adoption agencies and in many cases adoptive parents too. If their interests were in the actual child they would see clearly that Inter-Country adoptions was not in the child&#8217;s best interest.

In 2009 when Hillary Clinton met the Romanian foreign Minister he was handed a letter urging Romania to reform this ban on Inter Country Adoptions so that children could again be exported for huge sums of hard cash to foreign couples despite the fact there are few orphans available in Romania for adoption nowadays. The EU funded childcare reforms saw the closure of the massive old style orphanages of the early 1990s. It was I also add the EU that insisted that Romania actually stop Inter Country Adoptions after the discovery of massive corruption within the old system of Inter Country Adoptions. The problem is that Hillary Clinton clearly seems to support along with many US senators the side of these large well funded adoption agencies that make huge profits out of the financial transactions of Romanian children and they continue to lobby unjustly for children rather than accept the reality of a country that has actually been praised for its childcare reforms including by US childcare experts.

The fierce adoption lobby has now also infiltrated the EU and Council of Europe too and again in 2009 there was a conference named 'Challenges in Adoption Procedures' that clearly was aimed at re opening Romanian Inter Country Adoptions again and even talk of a new way to mask these kinds of adoptions as European adoptions! Hidding in the back of this group is French business man and adoption lobbyist Francois de Combret with his NGOs SERA and CARE France and former EP parliament member Claire Gibault.

The conference resolved nothing as there was no agreement between the parties present headed by the largest lobbyists in Europe today. It must also be stated that Romania is a sovereign Country and has the right to offer is children the best protection available and rule its own affairs providing they do not break international law. In the case of International adoptions they certainly do not break international law or the ban which was supported by EU and financed by them would never have been allowed anyway.

Now today the Romanian child care case is being heard again in the The European Parliament Petitions Commission in a case brought by Amici dei Bambini, one of the largest Italian adoption agencies. It also comes at a time when the Commission's president is Italian Erminia Mazzoni, who support Amici Dei Bambini and many of her co nationals who look to adopt a child. In this petition Amici dei Bambini president Marco Griffini calls for a reversal of the ban again despite the fact that in his own Country they have themselves massive unresolved childcare problems!

In Romania between 1990 and 1997 10.000 plus children were exported to by agencies to foreign couples with no trace of them since ever being reported. What happened to these children and were are they now I ask?

The Romanian Office for Adoptions in its searches has found that in this period an inventory shows only the numbers of children adopted, no names, addresses or to were they went.

There is still today no news of what happened to 16.041 Romanian children exported for profit abroad. With no post adoption reports as required sent back to Romania it is clear that there are huge dangers in these kinds of adoptions and this fact remains today. The actual 16.041 figure could be higher as many children who went abroad for adoption in were never registered at all and no one knows were they went to or to whom or if are alive or dead.

It is therefore with absolute Right that Romania banned Inter-Country Adoptions and reformed its childcare to EU standards with full EU support and gave its children protection from being trafficked abroad to the highest bidder who contacted an adoption agency. Prices of upwards of 30.000 Euro was changing hands for a child and the interest of the child was never considered, plus because of these high prices Romanian couples were unable to adopt also as agencies placed children direct to foreign couples first.

The Romanian child care reforms saw the largest majority of children re untited with their biological parents or relatives, the introduction of Foster Care as in all of Europe (and the US likewise) family type modern homes for children in need of support and the development of a national Romanian adoption system for the many Romanians who themselves want to adopt a child, plus it is with adding here that there are twice as many Romanians listed as wishing to adopt a child as children available today, thus again proving there is now no need for Inter Country Adoptions. The Romanian national adoption system is in compliance also legally with the Hague convention on the rights of the child.

Online investigation into overseas adoptions


ELIZABETH JACKSON: A couple of weeks ago we featured an interview with Mary Ann Jolley from ABC TV's Foreign Correspondent program.

Mary Ann had an alarming story to tell about the largely unregulated inter-country adoption industry in the US.

There were allegations that both children and adoptive parents were lied to by one particular adoption agency in Ethiopia, and as a result one young girl said she felt like she'd been sold.

Journee Bradshaw was told she would go to school in America, and would visit her family in Ethiopia often. Her adoptive family were told that Journee's father was dying from AIDS and that she would most likely become a prostitute. All lies.

Lots of money was exchanged during the adoption process and at the end of it many people felt cheated.

The ABC's online investigative unit followed up the story with Australian families who'd adopted children from Ethiopia and what it found was chilling.

Suzanne Smith is the ABC's news online investigations editor. I asked her what she'd discovered.

SUZANNE SMITH: At the end of the Foreign Correspondent program we did a call out to the Australian audience because we'd already heard that there'd been problems with the Australian Ethiopian adoption program.

Now what we got back was a lot of information from families who had travelled to Ethiopia - Australian families - and some pretty heart breaking stories about what they saw, what they went through.

The process, whether you want to call it child trafficking, there are certainly serious issues about the process. Some families witnessed Ethiopian mothers falling to the ground screaming when they couldn't find their children; their children had already been taken away and been adopted.

They talked about having to pay donations to the Australian Government representative to fast track their adoptions.

They talked about the fact that the… in Ethiopia the Australian Government sponsors a place which is like a hostel where the children come from the families and then they wait in this hostel before they're given to Australian families to come home; it's called Koala House.

Now, some of those families reported to us that they thought those children were only being fed one meal a day.

So you know, this raises serious questions about whether these children are being treated properly, and clearly in the evidence we got from Australian families was very similar things were happening to what was discovered by Foreign Correspondent in America.

Some families found the children hadn't been abandoned; so they had parents; they weren't orphans. They found the ages were wrong. Just very similar circumstances to the American situation.

And of concern as well, kids are coming from the same pool.

ELIZABETH JACKSON: So, there's serious issues to be raised here about whether the Australian Government, given the situation in Ethiopia - how difficult the poverty, the dysfunction, the systemic corruption - whether the Australian Government can be sure that were not adopting children that are in fact kidnapped from families or families have had pressure put on them.

SUZANNE SMITH: Look, the fact is whatever's happening there, it's not acceptable. It's not up to Australian standards and there needs to be more transparency.

And I understand that the Attorney-General's department is sending more staff over there to investigate further. They did suspend the program after the first Foreign Correspondent program went to air last year. They are saying it will resume in early April.

But in 2005 the former government looked into the program and found 44 serious issues and that involved the same Australian representative that is there now.

So the fact… the issue now for the Attorney-General is that Australian Government representative is still there; he's still operating; he's still our conduit with the families and there are people within the adoption industry who are concerned that perhaps he and his operation hasn't been investigated seriously enough.

ELIZABETH JACKSON: So if there were 44 negative outcomes from an investigation carried out by the Australian government back in 2005, what was done about that?

SUZANNE SMITH: Roelie Post from Against Child Trafficking in Europe actually sent the Australian Government in 2008 a pile of documents about the same Australian Government representative, that he had been arrested for allegedly being involved in child trafficking children to Austria in 2008.

Now, the Australian Government has investigated that and they've come back to us to say no, that was just a case of mistaken identity - Austria, Australia.

However, we've got the statement from the biological mother who was involved in that case - it's on the website - which says she identifies the Australian Government representative as being involved.

And Roelie Post from Against Child Trafficking, which is a respected NGO, says the Australian Government has not investigated that issue seriously enough.

They can't find in any of the Ethiopian Government documents any reference to the fact it was a case of mistaken identity.

ELIZABETH JACKSON: Have you spoken to anyone else Suzie apart from Roelie Post, who you've just mentioned, who… from someone in a position of authority who corroborates these allegations?

SUZANNE SMITH: Lots of people have corroborated these allegations outside of Australia and inside.

Many of the families that we've talked to don't want to be named because there's still legal issue spending on their children, and they're concerned about the effect on their children.

Frauenhandel –gestern und heute


Am 8. März 2010 fand im Konferenzzentrum der Hanns-Seidel-Stiftung München die 10. Fachtagung des Fachtagung des Aktionsbündnisses gegen Frauenhandel statt. Diese Tagungen dienen nicht nur der Information und kritischen Diskussion, sondern auch der Bewusstseinsschärfung, Lobbyarbeit und Netzwerkbildung. Im Jahr 2010 wird das Aktionsbündnis gegen Frauenhandel in Bayern zehn Jahre alt – Gelegenheit für einen umfassenden Überblick über die mit Frauenhandel und Zwangsprostitution verbundenen Probleme. In unserer diesjährigen Fachtagung haben wir eine Bestandsaufnahme versucht und geschichtliche Aspekte des Themas ebenso beleuchtet wie die Frage, wo wir gegenwärtig in der Bekämpfung des Frauenhandels stehen und welche Perspektiven für morgen wir im Umgang mit dieser Problematik sehen.

In Straubenhardt wird gegen eine Frau ermittelt, die der Prostitution nachgegangen sein soll.

Brasilianerin wegen Verdacht auf Prostitution verhaftet


STRAUBENHARDT. Die Kriminalpolizei und das Ordnungsamt der Gemeinde Straubenhardt ermitteln nach den Aussagen von Bürgermeister Willy Rutschmann und Polizeisprecher Michael Sengle gegen eine junge Frau, die in Straubenhardt in der Wohnung eines 58 Jahre alten Mannes dem horizontalen Gewerbe nachgehen soll.

Die 21 Jahre alte Brasilianerin ist inzwischen verhaftet worden. Laut Sengle besteht kein Zweifel daran, dass sie illegal im Land ist und abgeschoben wird.

Nach der Prostitutionsverordnung der Landesregierung Baden-Württemberg von 1976 darf kein bordellartiger Betrieb in Gemeinden ausgeübt werden, die weniger als 35 000 Einwohner haben.

Gegenüber der PZ erzählte der 58 Jahre alte Straubenhardter, dass er seine brasilianische Freundin bald heiraten wolle. Er habe nie vorgehabt, ein Gewerbe zu betreiben. Vielmehr seien die Inserate auf einschlägigen Internetseiten einem offenen Umgang mit Sexualität und dem Festigen ihrer gemeinsamen Beziehung geschuldet gewesen.

Prostitutionsverdacht: Brasilianerin wieder auf freiem Fuß

STRAUBENHARDT. Eine 21 Jahre alte Brasilianerin, die von der Kriminalpolizei in Straubenhardt aufgrund des Verdachts der Prostitution festgenommen worden ist, ist wieder auf freiem Fuß.

Sie hatte im Haus eines 58 Jahre alten Straubenhardters ihre Dienste angeboten, auf einschlägigen Webseiten damit geworben. Laut Informationen der PZ ist sie illegal in Deutschland und reist freiwillig am 9. April in ihr Heimatland zurück. Laut Angaben des 58-Jährigen habe sie ihre Dienste nicht zum Geldverdienen angeboten, sondern um ihre gemeinsame Beziehung lebendig zu halten.

Deutsche Bundesregierung:

Kein Lagebericht zu Kinderhandel


Anlässlich der kleinen Anfrage von Abgeordneten der Fraktion BÜNDNIS 90/DIE GRÜNEN (Drucksache 17/92), erklärte die Bundesregierung, dass sie trotz Forderungen vieler Fachverbände keinen Lagebericht zu Kinderhandel erstellen wird. Es bestehe „kein Bedarf für die Erstellung eines spezifischen Lagebildes „Kinderhandel“, da dieser Bereich durch das bereits bestehende Bundeslagebild „Menschenhandel“ mit abgedeckt“ werde.

Außerdem seien die Opferzahlen zu niedrig um eine aussagekräftiges Lagebild anzugeben.

2005: _3 Kinder unter 14 Jahre,
2006: _0 (keine),
2007: _7 und
2008: 20

Zu diesem Beschluss sei zudem die polizeiliche Bund-Länder-Kommission Kriminalitätsbekämpfung (KKB) gekommen.

Neue OSZE-Sonderbeauftragte für die Bekämpfung des Menschenhandels

Die italienische Richterin und EU-Kommissionsexpertin Maria Grazia Giammarinaro ist von der Organisation für Sicherheit und Zusammenarbeit in Europa (OSZE) zur neuen Sonderbeauftragten und Koordinatorin für die Bekämpfung des Menschenhandels ernannt worden. Seit Januar ist sie im Amt, das sie von Eva Biaudet übernommen hat.

Internationaler Gewerkschaftsbund (IGB/ITUC)


Das internationale Gewerkschaftsbündnis gegen Zwangsarbeit und Menschenhandel, das vom Internationalen Gewerkschaftsbund (IGB/ITUC) angeführt wird, veröffentlichte ihr sechstes Nachrichtenblatt. Darin wird u. a. berichtet, dass der Paneuropäische Regionalrat des IGB eng zusammen mit Anti-Slavery und La Strada zusammenarbeitet, um einen europäischen Zusammenschluss zur Bekämpfung des Menschenhandels zum Zweck der Arbeitskraftausbeutung aufzubauen. Zum 20-jährigen Bestehen der Konvention zum Schutz der Rechte von MigrantInnen startet der Internationale Lenkungssausschuss für die Kampagne zur Ratifizierung der UN-Konvention zum Schutz der Rechte von MigrantInnen eine weltweite Kampagne, in der es dazu aufrief, den Missbrauch von WanderarbeiterInnen durch einen stärkeren Schutz ihrer Menschenrechte zu beenden.

MigrantInnen Arbeitsgemeinschaft MigrAr/ver.di Hamburg:

Kampf für die Rechte von ArbeitnehmerInnen ohne gesicherten Aufenthaltsstatus


Das Arbeitsgericht Celle hat der Klage eines illegal in Deutschland arbeitenden Serben über Lohnnachzahlungen aus einem undokumentierten Arbeitsverhältnis stattgegeben.

Emilija Mitrovi&#263; von der gewerkschaftlichen Anlaufstelle von ver.di für MigrantInnen ohne gesicherten Aufenthalt, MigrAr, in Hamburg begrüßte diese Entscheidung, da die grundlegenden Arbeitsrechte für jedeN BeschäftigteN, unabhängig vom Aufenthaltsstaus gelten. Dazu gehören neben dem Recht auf angemessenen Lohn auch der Unfallschutz, Mindesturlaub und die Entgeltfortzahlung im Krankheitsfall. Jedoch befinden sich undokumentierte ArbeitnehmerInnen oft in prekären oder ausbeuterischen Situationen und vermeiden den Rechtsweg, um ihre Rechte einzuklagen. Die Geltendmachung von Lohnansprüchen vor den Arbeitsgerichten ist grundsätzlich auch ohne den Besitz eines Aufenthaltstitels möglich. Allerdings kann die Beschreitung des Rechtsweges dazu führen, dass die Ausländerbehörde Kenntnis von dem Aufenthalt erhält.
